PROPERTY CRAZE™ will manage personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply, together with other legal and regulatory requirements relevant to its activities.

How Personal Information Is Collected

PROPERTY CRAZE™ may collect personal information directly from an individual or, where appropriate, from another authorised or relevant source.

Information may be collected through:

  • the PROPERTY CRAZE™ website and Contact function;
  • the PROPERTY CRAZE™ Online Portal;

Where PROPERTY CRAZE™ receives personal information about an individual from another source, it will manage that information consistently with the purpose for which it was collected and its privacy obligations.

Why Personal Information Is Collected, Held and Used

PROPERTY CRAZE™ may collect, hold and use personal information to:

  • respond to enquiries and communications;
  • assess and administer Real Estate Agency participation;
  • verify agency identity, licensing, authority and business information;
  • administer Property For Sale Listing submissions;

Where personal information is collected for a particular purpose, PROPERTY CRAZE™ will not use or disclose it for an unrelated purpose unless authorised by the individual or permitted or required by law.

Property Owner Information

PROPERTY CRAZE™ requires accurate Property Owner information to administer the Property For Sale Listing and prize-draw process.

Every legal Property Owner identified through the Current Official Property-Title Search must be separately recorded and complete the required confirmation process before a Prize Draw Entry can proceed.

PROPERTY CRAZE™ may therefore receive Property Owner information directly from the Property Owner, from the Participating Real Estate Agency responsible for the Property For Sale Listing and from authorised verification sources.

Anonymity and Pseudonyms

Individuals may make a general enquiry without identifying themselves, or by using a pseudonym, where it is practical and lawful to do so.

Identification will be required where PROPERTY CRAZE™ cannot reasonably perform the relevant function without confirming identity. This includes activities such as Property Owner verification, Real Estate Agency participation, Prize Draw Entries, winner verification, prize delivery and certain access or correction requests.

Direct Marketing

Participation in PROPERTY CRAZE™ activities does not provide blanket consent to receive direct marketing.

Where PROPERTY CRAZE™ seeks consent for direct marketing, that choice will be separate from participation in the relevant PROPERTY CRAZE™ activity.

Individuals receiving direct marketing from PROPERTY CRAZE™ will be provided with a simple means of opting out and may ask PROPERTY CRAZE™ to stop sending those communications.

Disclosure of Personal Information

PROPERTY CRAZE™ may disclose personal information where reasonably required for its functions and activities.

Depending on the circumstances, information may be disclosed to:

  • Participating Real Estate Agencies;
  • Property Owners connected with the same Property For Sale Listing;
  • National Partners and Prize Suppliers where information is required for an authorised activity;
  • independent draw administrators and scrutineers;
  • professional advisers, accountants, auditors and legal advisers;
  • technology, authentication, payment and operational service providers;
  • organisations involved in winner verification and prize delivery; and
  • regulators, courts, government agencies and law-enforcement bodies where disclosure is required or authorised by law.

PROPERTY CRAZE™ will not sell personal information to third parties.

Overseas Disclosure

PROPERTY CRAZE™’s final technology, data-hosting and service-provider arrangements are being established as part of commercial delivery.

Before personal information is disclosed to overseas recipients, PROPERTY CRAZE™ will assess the relevant privacy requirements and update this Privacy Policy to identify overseas disclosure arrangements and countries where required.

Website, Cookies and Analytics

The PROPERTY CRAZE™ website may use cookies or similar technologies required for website functionality, security and performance.

Any analytics, advertising or other tracking technologies used by PROPERTY CRAZE™ will be assessed as part of the website and technology implementation. Where those technologies collect or use personal information, appropriate information and choices will be provided.

PROPERTY CRAZE™ does not represent that it uses a particular analytics, advertising or tracking provider unless that provider has been implemented and the relevant privacy arrangements have been confirmed.

Security of Personal Information

PROPERTY CRAZE™ will take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

Security arrangements will reflect the nature of the information and the systems through which it is collected and held. These arrangements may include controlled access, authentication, electronic-signature controls, audit records, secure record management, backups and incident-response processes.

Where external service providers handle personal information for PROPERTY CRAZE™, appropriate privacy, confidentiality and security requirements will form part of the relevant arrangements.

Retention and Disposal

PROPERTY CRAZE™ will retain personal information for as long as reasonably required for its business activities and legal, regulatory, governance and record-management responsibilities.

Where personal information is no longer required to be retained, PROPERTY CRAZE™ will take reasonable steps to securely destroy or de-identify it, subject to legal and record-retention requirements.

PROPERTY CRAZE™ may require reasonable identity verification before providing access or making a correction.

Where access or correction cannot be provided, PROPERTY CRAZE™ will respond in accordance with its legal obligations and explain the position where required.
